1. Acceptance of Terms

By accessing or playing TapMogul (the "Game") available at playtapmogul.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Game. These Terms constitute a legally binding agreement between you and the operator of TapMogul. Your continued use of the Game after any changes to these Terms constitutes acceptance of the updated Terms. We recommend that you review these Terms periodically to stay informed of any updates.

2. Eligibility

You must be at least 18 years of age to use TapMogul. By accessing or using the Game, you represent and warrant that you are 18 years of age or older. If you are under 18, you are not permitted to use this service. We do not knowingly allow persons under 18 to create accounts or participate in any features of the Game, including the optional leaderboard, or any other user-facing feature. If we become aware that a user is under 18, we reserve the right to immediately suspend or permanently terminate that user's access without notice.

3. Description of Service

TapMogul is a free-to-play browser-based idle clicker game. Players tap a button to earn virtual in-game currency, purchase generators that earn currency automatically over time, and compete on a global leaderboard using Mogul Points. Players can progress through business tiers — from Sole Proprietor to LLC, Corporation, and Conglomerate — by accumulating lifetime Mogul Points. The Game is provided entirely free of charge. No real money is required to play, and no real monetary value is attached to any in-game currency, items, or progress. The Game is supported by optional rewarded advertising through Google's H5 Games Ads platform.

4. Free to Play — No Real-Money Purchases

All in-game currency, generators, upgrades, prestige multipliers, and virtual items in TapMogul have no real-world monetary value. They cannot be exchanged for real money, goods, or services. TapMogul does not offer any in-app purchases or microtransactions of any kind. Any virtual currency or game progress is for entertainment purposes only and may be reset or deleted at any time as part of updates or maintenance. You acknowledge that loss of game progress or in-game items does not entitle you to any monetary compensation or refund of any kind.

5. Advertising

TapMogul is supported by advertising through Google AdSense and Google H5 Games Ads. Rewarded advertisements are entirely optional — you may choose to watch a short advertisement in exchange for in-game bonuses such as a temporary income multiplier, vault collection, or generator unlocks. You are never required to watch an advertisement in order to progress in the game or access any core functionality. By using the Game, you consent to the display of advertisements served in accordance with Google's advertising policies. Google may use cookies and device identifiers to serve interest-based advertisements. You may manage your ad preferences at Google's Ad Settings.

6. User Conduct

You agree not to:

Attempt to exploit, hack, cheat, or manipulate the Game or its leaderboard systems
Use automated scripts, bots, macros, or tools to artificially generate in-game currency or Mogul Points
Submit false or misleading information in the leaderboard identity system
Attempt to interfere with the Game's servers, infrastructure, databases, or other players' experience
Use the Game for any unlawful purpose or in violation of any applicable laws or regulations
Share, transfer, or sell access to any game account or leaderboard standing
Attempt to reverse-engineer, decompile, or otherwise extract the source code of the Game

We reserve the right to remove any account, reset leaderboard standings, or block access for users who violate these conduct rules, with or without prior notice.

7. Intellectual Property

All content in TapMogul, including but not limited to game logic, design, graphics, text, sounds, animations, and data structures, is the property of the TapMogul operator. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and play the Game for personal, non-commercial use only. You may not copy, modify, distribute, sell, sublicense, or create derivative works from any content in TapMogul without express written permission from the operator. Any feedback, suggestions, or ideas you provide about the Game may be used by the operator without obligation to you.

8. Disclaimers and Limitation of Liability

The Game is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Game will be uninterrupted, error-free, secure, or free of viruses or other harmful components. To the fullest extent permitted by applicable law, the operator of TapMogul shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of or inability to use the Game, including loss of game progress, loss of data, or loss of any virtual items, regardless of the theory of liability and even if we have been advised of the possibility of such damages.

9. Game Data and Progress

Your game progress is stored in your browser's local storage and, if you create a leaderboard identity, in Google Firebase Firestore under an anonymous account. We make reasonable efforts to preserve game data, but we do not guarantee that your progress will be retained indefinitely. We reserve the right to reset, modify, or delete game data as part of game updates, server maintenance, anti-cheat enforcement, or service discontinuation. You acknowledge that loss of game progress, business tier status, or any other in-game element does not entitle you to any compensation, refund, or claim of any kind.

10. Modifications to the Game and Terms

We reserve the right to modify, suspend, or discontinue TapMogul or any feature of the Game at any time, with or without notice. This includes changes to game mechanics, generator values, prestige multipliers, Mogul Point calculations, and leaderboard systems. We may also update these Terms at any time. Continued use of the Game after changes are posted constitutes acceptance of the updated Terms. The most current version of these Terms will always be available at playtapmogul.com/terms.

11. GDPR — Rights of European Union Users

If you are located in the European Union or European Economic Area, the General Data Protection Regulation (GDPR) grants you the following rights with respect to your personal data:

Right of Access: You have the right to request a copy of the personal data we hold about you.
Right to Rectification: You have the right to request correction of inaccurate or incomplete personal data.
Right to Erasure ("Right to be Forgotten"): You have the right to request deletion of your personal data, subject to applicable legal obligations.
Right to Data Portability: You have the right to receive your personal data in a structured, commonly used, machine-readable format and to transmit that data to another controller.
Right to Object: You have the right to object to the processing of your personal data for direct marketing purposes or where processing is based on legitimate interests.
Right to Restrict Processing: You have the right to request that we limit the processing of your personal data in certain circumstances.

To exercise any of these rights, contact us at support@playtapmogul.com. We will respond to all verifiable requests within 30 days. Note that TapMogul uses anonymous Firebase authentication — no real name or email is collected.

12. CCPA — Rights of California Users

If you are a California resident, the California Consumer Privacy Act (CCPA) grants you the following rights:

Right to Know: You have the right to request information about the categories and specific pieces of personal information we have collected about you, the sources from which it was collected, the purposes for which it is used, and the categories of third parties with whom it is shared.
Right to Delete: You have the right to request deletion of personal information we have collected from you, subject to certain exceptions permitted by law.
Right to Opt-Out of Sale: TapMogul does not sell personal information to third parties. You therefore have no opt-out action required, but you retain this right should our practices change.
Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. We will not deny you the Game, charge you different prices, or provide a different level of service because you exercised your privacy rights.

To submit a verifiable consumer request under the CCPA, contact us at support@playtapmogul.com. We may need to verify your identity before processing your request. We will respond within 45 days of receiving a verifiable request.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-law principles. Any disputes arising from these Terms or your use of TapMogul shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in New Jersey. You waive any right to participate in a class action lawsuit or class-wide arbitration.
